Abstract
La gig-economy al vaglio delle Corti britanniche: self-employed or workers? – Riassunto. La qualificazione del rapporto di lavoro dei cd. riders ha formato oggetto di una decisione della UK Supreme Court, la quale, ha sancito la riconducibilità di tali individui a un terzo genere di lavoratore britannico, il cd. worker, una sorta di lavoratore autonomo. Il presente contributo possiede, di conseguenza, l’obiettivo di analizzare la categoria dei workers proprio in base al recente dictum della Suprema Corte Britannica. Al fine di perseguire il risultato dichiarato, si procederà a fornire una breve introduzione circa la gig-economy per poi affrontare la disamina da un punto di vista di common law britannico.
The gig economy screened by the British Courts: self-employed or workers? – Summary. The qualification of the work relationship of the “riders” has been the subject-matter of a UK Supreme Court decision, which has “spelt out” a new, fundamental principle: the link existing between these individuals and a third area of workers (pursuant to the British statutes): sui generis workers, that is to say a kind of self-employed individuals. Bearing this in mind, the purpose of this contribution is to discuss and analyse the specific category of workers stemming from the recent dictum of the highest judiciary body in Great Britain. In order to pursue the above goal, the contribution provides a legal analysis about the gig-economy and, therefore, the common law approach taken to this niche, albeit everchanging and overwhelming, sector of the job market.
